Terms of Service

1. The Agreement

By subscribing to services provided by The Web Fitter ("we", "us"), you ("the Client") agree to be bound by these terms. This is a binding legal agreement. If you do not agree to these terms, you must not use our services.

2. Service Definition

We provide a "Productized Website Service". This includes the design, hosting, maintenance, and technical management of a website for your trade business. You are paying for a service (Subscription), not purchasing a finished product asset.

3. Intellectual Property (Ownership)

  • What YOU Own: You retain full ownership of your domain name (URL), your business logo, and the text/images you provide to us.
  • What WE Own: The Web Fitter retains full ownership of the website source code, design templates, server architecture, and database configurations.

The "Gym Membership" Clause: Think of this service like a gym membership. You pay for access to the equipment (the website code and hosting). If you cancel your membership, you do not get to take the gym equipment home with you. However, you are free to take your personal belongings (your domain name and content) elsewhere.

4. Payments & "The Kill Switch"

  • Fees: Services are billed monthly via Stripe. The "Fitting Fee" (£149.99) is a one-time non-refundable setup cost.
  • Late Payments: If a payment fails, we will attempt to retry for 7 days.
  • Suspension: If payment remains outstanding after 7 days, your website will be automatically suspended (taken offline) until the balance is cleared.

5. Scope of Support (Fair Usage)

Our "Digital Handyman" service includes unlimited standard updates. This is defined as:

  • Changing text (e.g., price lists, phone numbers).
  • Swapping images (e.g., new project photos).
  • Updating business hours.

Exclusions: This does not cover structural redesigns, adding e-commerce functionality, or building new pages beyond the original scope. These are billable at £20 per request or a fixed project fee.

6. AI Disclaimer (Pro Tier)

For clients on the Pro Fit tier utilizing "NeverMiss™ AI": We strive for accuracy, but AI technology can occasionally generate incorrect responses. The Web Fitter is not liable for any misinformation provided to your customers by the AI bot. It is the Client's responsibility to monitor AI interactions.

7. Limitation of Liability

To the maximum extent permitted by UK law, The Web Fitter shall not be liable for any indirect, incidental, or consequential damages (including lost profits or lost business opportunities) resulting from website downtime, server failure, or third-party (Google/Netlify) service interruptions.

Liability Cap: Our total liability for any claim arising out of this agreement shall not exceed the total amount paid by the Client in the one (1) month preceding the claim.

8. Cancellation

You may cancel at any time via the Stripe Customer Portal or by emailing hello@thewebfitter.co.uk . Upon cancellation, your website will remain active until the end of the current billing period, after which it will be taken offline and deleted from our servers.
